The interplay of academics and judges is highly relevant for the law-making process in civil law countries. The intention of this article is to provide a brief account of the present-day relationship between academics and judges in Italy, while also taking account of the continental historical experience. In addressing this theme, the article will take its cue from developments in England—during the past three decades—where the monologue of academics and judges has been slowly developing into an ever more intensive and (...) transparent dialogue. This article addresses theoretical problems around the notion of ‘choice’, using empirical data from a three-year, ESRC-funded study of identity, transition and footwear among both women and men. With a focus on female participants who wore, or had worn high-heeled shoes, it draws on Budgeon’s argument for viewing the body as event, as becoming, and Finch’s use of the concept of display, to explore the temporalities of high-heeled shoe wear, particularly as an aspect of ‘dressing up’. Data from both focus (...) groups and year-long case studies allowed everyday and life course patterns of high-heeled shoe wear to be explored – in many cases, as they unfolded. This material has led us to critique the linear, goal-oriented nature of a modernist ‘project of the self’, and to argue that identification, as a dynamic process, may often be erratic, partial and temporary. Emphasized femininity, it is suggested, can be ‘displayed’ episodically, as an aspect of ‘doing gender’, a perspective that problematizes notions of a ‘post-feminist masquerade’ that inevitably secures gender retrenchment. Through an examination of the occasions and non-occasions that pattern the temporalities of women’s lives, therefore, the article demonstrates a distinction between displaying femininity and doing gender, one that simultaneously sheds light on their relationship with one another. This article draws on the conceptualisation of ‘discursive formation’ to examine the particular configuration of the ‘objects, subjects, concepts and strategies’ which constituted ‘nuclear proliferation’ between 2006 and 2012. While previous studies have mostly explored the discourse of nuclear proliferation through the analysis of newspaper texts, few have considered corpora from different sites or considered the changes, transformations and contradictions that take place when meanings are delocated from one site and relocated in another. Elements of poststructuralist discourse theory, critical linguistics (...) and corpus linguistics are brought together to consider how events were constructed within two corpora: UN Security Council resolutions and newspaper articles published in prominent UK and US broadsheets. WordSmith Tools was used to analyse word frequencies, statistical patterns of keywords, word collocation profiles and concordance patterns. Results indicate that the most salient lexical items refer to actors, strategic actions and technologies. As these constituents of nuclear proliferation are delocated from the political sphere and relocated in the public sphere, three discursive strategies unfold: personalisation, normalisation or exceptionalisation, and reification. BackgroundWithholding and withdrawing treatment are deemed ethically equivalent by most Bioethicists, but intensivists often find withdrawing more difficult in practice. This can lead to futile treatment being prolonged. Time-limited trials have been proposed as a way of promoting timely treatment withdrawal whilst giving the patient the greatest chance of recovery. Despite being in UK guidelines, time-limited trials have been infrequently implemented on Intensive Care Units. We will explore the role of time in Intensive Care Unit decision-making and provide a UK (...) perspective on debates surrounding time-limited trials.MethodsThis qualitative study recruited 18 participants (nine doctors, nine nurses) from two Intensive Care Units in North West England for in-depth, one-to-one semi-structured interviews. A thematic analysis was performed of the data.ResultsOur findings show time is utilised by Intensive Care Unit staff in a variety of ways including managing uncertainty when making decisions about a patient’s prognosis or the reversibility of a disease, constructing relationships with patients’ relatives, communicating difficult messages to patients’ relatives, justifying resource allocation decisions to colleagues, and demonstrating compassion towards patients and their families.ConclusionsTime shifts the balance towards greater certainty in Intensive Care Unit decision-making, by demonstrating futility, and can ease the difficult transition for staff and families from active treatment to palliation. However, this requires clear and open communication, both within the Intensive Care Unit team and with the family, being prioritised when time is used in decision-making. (shrink)

Recent arguments claim that behavioral science has focused – to its detriment – on the individual over the system when construing behavioral interventions. In this commentary, we argue that tackling economic inequality using both framings in tandem is invaluable. By studying individuals who have overcome inequality, “positive deviants,” and the system limitations they navigate, we offer potentially greater policy solutions.

Although self‐testing apps, a form of mobile health (mHealth) apps, are often marketed as empowering, it is not obvious how exactly they can empower their users—and in which sense of the word. In this article, I discuss two conceptualisations of empowerment as polar opposites—one in health promotion/mHealth and one in feminist theory—and demonstrate how both their applications to individually used self‐testing apps run into problems. The first, prevalent in health promotion and mHealth, focuses on internal states and understands empowerment as (...) an individual process. However, this version of empowerment has been accused of paternalism and responsibilisation. The second, feminist version considers structural conditions and foregrounds collective, political change, whose realisation is not obviously attainable for an individually used app. By pointing out the flaws of the positions that focus on either internal states or external conditions, and by engaging with theory from critical phenomenology, I argue that the interplay between them is where empowerment can take place. I propose to formulate empowerment in phenomenological terms as a shift in being‐in‐the‐world and discuss how this conceptualisation of empowerment would avoid the criticism of previous empowerment narratives while being realisable by self‐testing apps. Scholars have critiqued mainstream economic approaches to environmental valuation for decades. These critiques have intensified with the increased prominence of environmental valuation in decision-making. This paper has three goals. First, we summarise prominent critiques of monetary valuation, drawing mostly on the work of Clive Spash, who worked extensively on cost–benefit analysis early in his career and then became one of monetary valuation's most thorough and ardent critics. Second, we, as a group of scholars who study relational values, describe how relational (...) values research engages with and addresses many of the critiques of monetary valuation. Third, we offer suggestions for relational values research that continues and deepens its ability to respond to critiques of monetary valuation and contributes to transformative change towards sustainability. This review aims to search the literature, present and critically discuss published Empirical Bioethics methodologies.

Thinking about model organisms enables us to examine how living organisms have been brought into the laboratory and used to gain a better understanding of biology, and to explore the research practices, commitments, and norms underlying this understanding. We contend that model organisms are key components of a distinctive way of doing research. Philosophers have long been interested in love and its general role in morality. This volume focuses on and explores the complex relation between love and justice as it appears within loving relationships, between lovers and their wider social context, and the broader political realm. Special attention is paid to the ensuing challenge of understanding and respecting the lovers’ personal autonomy in all three contexts. Accordingly, the essays in this volume are divided into three thematic sections. Section I aims at shedding (...) further light on conceptual and practical issues concerning the compatibility or incompatibility of love and justice within relationships of love. For example, are loving relations inherently unjust? Might love require justice? Or do love and justice belong to distinct moral domains? The essays in Section II consider the relation between the lovers on the one hand and their broader societal environment on the other. Specifically, how exactly are love and impartiality related? Are they compatible or not? Is it unjust to favor one’s beloved? Finally, Section III looks at the political dimensions of love and justice. How, for instance, do various accounts of love inform how we are to relate to our fellow citizens? If love is taken to play an important role in fostering or hindering the development of personal autonomy, what are the political implications that need to be addressed, and how? In addressing these questions, this book engenders a better understanding both of conceptual and practical issues regarding the relation between love, justice, and autonomy as well as their broader societal and political implications. It is uncontroversial that something goes wrong with the blaming practices of hypocrites. However, it is more difficult to pinpoint exactly what is objectionable about their blaming practices. I contend that, just as epistemologists have recently done with blame, we can constructively treat hypocrisy as admitting of an epistemic species. This paper has two objectives: first, to identify the epistemic fault in epistemically hypocritical blame, and second, to explain why epistemically hypocritical blamers lose their standing to epistemically blame. I tackle (...) the first problem by appealing to an epistemic norm of consistency. I address the second by arguing that the epistemically hypocritical blamer commits to an opting-out of the set of shared epistemic standards that importantly underlies our standing to epistemically blame. I argue further that being epistemically hypocritical undermines a blamer’s standing even to judge epistemically blameworthy. (shrink)

Il n’est pas étonnant que Cora Diamond fasse un cas de toutes ces expériences : ce qu’elle nomme « une difficulté (...) de la réalité », c’est-à-dire un point d’achoppement entre la pensée et ce qu’elle essaye de saisir, le réel, qui est susceptible de nous faire perdre nos concepts. Je me propose dans ce texte d’explorer les voies de cette difficulté, qui sont souvent des voies contournées ou des déviations. Names and natural kind terms have long been a major focus of debates about meaning and reference. This article discusses some of the theories and arguments that have appeared in those debates. It is remarkably difficult to say what names are without making controversial theoretical assumptions. This article does not attempt to do so here. It instead relies on paradigm examples that nearly all theorists would agree are proper names, for instance, ‘Aristotle’, ‘Mark Twain’, ‘London’, ‘Venus’, and ‘Pegasus’. All of (...) the proper names that are discussed in the article are singular nouns that have no syntactic structure. Most of them refer to objects, but some, such as ‘Pegasus’, apparently do not. L’interactivité est communément perçue comme la marque caractéristique des technologies digitales et, par extension, de différentes formes de fictions, de médias ou d’œuvres numériques – de la littérature hypertextuelle et des jeux vidéo au net art. On peut toutefois s’interroger sur le sens précis qu’il convient de donner à cette notion, ainsi que sur les promesses auxquelles elle est souvent associée. À défaut de pouvoir cerner un concept unique et maxi-englobant d’interactivité, nous suggérons qu’il est plus profitable de tenter d’identifier (...) des types et des degrés d’interactivité. Nous tentons de montrer pourquoi cette théorie pluraliste et gradualiste est plus attrayante que d’autres approches développées dans la littérature récente. Nous mettons enfin cette conception à l’épreuve du jeu vidéo, en montrant qu’elle permet de réévaluer le rôle que joue l’interactivité dans ce médium, mais qu’elle met aussi au jour les limitations inhérentes des fictions interactives que l’on y trouve. Empirical studies indicate that business compliance with the UK Modern Slavery Act is disappointing, but they struggle to make sense of this phenomenon. This article offers a novel framework to understand how business organizations construct the meaning of compliance with the UK Modern Slavery Act. Our analysis builds on the endogeneity of law theory developed by Edelman. Empirically, our study is based on the analysis of the modern slavery statements of 10 FTSE 100 (Financial Times Stock Exchange 100 Index) companies (...) in the food and tobacco sector, backed by interviews with business, civil society, and public officers. We offer a dynamic model that draws attention to the role of compliance professionals in framing ambiguous rules and devising a variety of organizational responses to modern slavery law. Contrary to extant research that tends to praise organizations for going “beyond compliance”, our study underlines the risks of managerialization of modern slavery law, whereby merely symbolic structures come to be associated with legal compliance, even when they are ineffective at tackling modern slavery. On the traditional relationalist conception of singular thought, a thought has singular content when it is based on an ‘information relation’ to its object. Recent work rejects relationalism and suggests singular thoughts are distinguished from descriptive thoughts by their inferential role: only thoughts with singular content can be employed in ‘direct’ inferences, or inferences that ‘trade on identity’. Firstly this view is insufficiently clear, because it conflates two distinct ideas—one about a kind of inference, the other a kind of process (...) that grounds inferences—under the title, ‘trading on identity’. Secondly, this leaves us without a notion that can be used as an alternative to relationalism about singular thought. The first notion is no more applicable to singular than to descriptive thought. The second may help us better understand singular thought, but does so, not by replacing the view that singular thoughts are information-based, but by helping us understand the nature of information-based thought. This paper examines what it is for a condition to be a disease. It falls into two sections. In the first I examine the best existing account of disease (as proposed by Christopher Boorse) and argue that it must be rejected. In the second I outline a more acceptable account of disease. According to this account, by disease we mean a condition that it is a bad thing to have, that is such that we consider the afflicted person to have (...) been unlucky, and that can potentially be medically treated. All three criteria must be fulfilled for a condition to be a disease. The criterion that for a condition to be a disease it must be a bad thing is required to distinguish the biologically different from the diseased. The claim that the sufferer must be unlucky is needed to distinguish diseases from conditions that are unpleasant but normal, for example teething. Finally, the claim that for a condition to be a disease it must be potentially medically treatable is needed to distinguish diseases from other types of misfortune, for example economic problems and legal problems. Rachel Cohon offers an original interpretation of the moral philosophy of David Hume, focusing on two areas.

The article argues that there are different ways of justifying suspension of judgement. We suspend judgement not only privatively, that is, because we lack evidence, but also positively, that is, because there is evidence that provides reasons for suspending judgement: suspension is more than the rational fallback position in cases of insufficient evidence. The article applies the distinction to recent discussions about the role of suspension for inquiry, Turri's puzzle about withholding, and formal representations of suspension.

Temporal discounting is the tendency to devalue temporally distant rewards. Past studies have examined the k-value, the indifference point, and the area under the curve as dependent measures on this task. The current study included these three measures and a fourth measure, called the interest rate total score. The interest rate total score was based on scoring only those items in which the delayed choice should be preferred given the expected return based on simple interest rates. In addition, associations with (...) several individual difference measures were examined including intelligence, executive functions (inhibition, working memory, and set-shifting), thinking dispositions (Need for Cognition and Consideration of Future Consequences) and engagement in substance use and gambling behavior. A staircase temporal discounting task was examined in a sample of 99 university students. Replicating previous studies, temporal discounting increased with longer delays to reward and decreased with higher reward magnitudes. A hyperbolic function accounted for variance in temporal discounting better than an exponential function. Reaction time at the indifference point was significantly longer than at the other choice points. The four dependent measures of temporal discounting were all significantly correlated and were also significantly associated with our individual difference measures. That is, the tendency to wait for a larger delayed reward on all of the temporal discounting measures was associated with higher intelligence, higher executive functions and more consideration of future consequences. Associations between our measures of temporal discounting and outcomes related to substance use and gambling behavior were modest in our university sample. (shrink)

Classifying Madness (Springer, 2005) concerns philosophical problems with the Diagnostic and Statistical Manual of Mental Disorders, more commonly known as the D.S.M. The D.S.M. is published by the American Psychiatric Association and aims to list and describe all mental disorders. The first half of Classifying Madness asks whether the project of constructing a classification of mental disorders that reflects natural distinctions makes sense. Chapters examine the nature of mental illness, and also consider whether mental disorders fall into natural kinds. The (...) second half of the book addresses epistemic worries. Even supposing a natural classification system to be possible in principle, there may be reasons to be suspicious of the categories included in the D.S.M. I examine the extent to which the D.S.M. depends on psychiatric theory, and look at how it has been shaped by social and financial factors. I aim to be critical of the D.S.M. without being antagonistic towards it. Ultimately, however, I am forced to conclude that although the D.S.M. is of immense practical importance, it is unlikely to come to reflect the natural structure of mental disorders. (shrink)

This article explores the politics of digital protest and emergent forms of sociality in the #NoDAPL movement using Elizabeth Povinelli’s concept of geontopower. I begin by situating the concept of geontopower in relation to a range of biopolitical, decolonial, and ecocritical theory in order to show its importance in conceptualizing the interconnectedness of decolonial and environmental interests. I use this theoretical framework to analyze several instances of what I call ‘digital decoloniality’ in the #NoDAPL movement, cases where the particular affordances (...) of social media technologies and the efforts of Indigenous activists and non-Indigenous allies disrupted normative assumptions regarding the boundaries of the digital and ‘analog’ worlds and resisted the geontopolitical structuring of life and nonlife. I argue that the #NoDAPL hashtag works to enact the prerogatives of Western science-based environmentalism and Indigenous epistemological tenets in common, performatively generating new possibilities for conceptualizing social struggle and shared history. In this paper, I provide an account of the wrong that is done to women when everyday people fail to believe allegations of sexual assault made by women. I argue that an everyday person wrongs both the accuser and women causally distant from the accuser when they fail to believe the accuser’s allegation. First, I argue that there are responses that we, as everyday members of society, owe to victims of sexual assault. A condition enabling everyday people to respond in (...) the way owed to victims is that they have an outright belief that the accuser was assaulted. Actively suspending judgement about whether a crime occurred is in tension with the ability to respond to the victim in a way that supports and validates them. When an everyday person fails to have an outright belief in the truth of an allegation, they wrong the accuser because they risk failing to satisfy the conditions enabling them to fulfill their obligation to her. Second, I argue that everyday people wrong women who are causally distant from the accuser because in our social context, women are often treated in particular ways – especially in the sexual domain – because they are women. As a result, when women hear that an everyday person fails to believe a particular allegation, they easily project themselves into the accuser’s position and reasonably worry that if they were to be assaulted, they too would be met with doubt and disbelief by the people in their community. I will discuss the relationship between two different accounts of remedial duty ascriptions. According to one account, the beneficiary account, individuals who benefit innocently from injustices ought to bear remedial responsibilities towards the victims of these injustices. According to another account, the causal account, individuals who caused injustices ought to bear remedial duties towards the victim. In this paper, I examine the relation between the principles central to these accounts: the Beneficiary Pays Principle and the well-established principle of Strict Liability (...) in law. I argue that both principles display a strong yet unexplored similarity as they make certain kinds of causal connection sufficient for incurring liability. Because of this similarity, I suggest that insights into the Beneficiary Pays Principle can be gained from exploring its relation with Strict Liability. In particular, I examine two new positive arguments that could be adapted to support of the Beneficiary Pays Principle: the Minimising Injustice Argument and the Normative Connection Argument. However, I’ll show that only one of those arguments, namely the Normative Connection Argument, can truly support the Beneficiary Pays Principle. I conclude that, if you endorse the Normative Connection Argument for Strict Liability, you have at least a strong prima facie reason to endorse the parallel argument for the Beneficiary Pays Principle. The aim of this paper is to propose a systematic classification of emotions which can also characterize their nature. The first challenge we address is the submission of clear criteria for a theory of emotions that determine which mental phenomena are emotions and which are not. We suggest that emotions as a subclass of mental states are determined by their functional roles. The second and main challenge is the presentation of a classification and theory of emotions that can account for (...) all existing varieties. We argue that we must classify emotions according to four developmental stages: 1. pre-emotions as unfocussed expressive emotion states, 2. basic emotions, 3. primary cognitive emotions, and 4. secondary cognitive emotions. We suggest four types of basic emotions (fear, anger, joy and sadness) which are systematically differentiated into a diversity of more complex emotions during emotional development. The classification distinguishes between basic and non-basic emotions and our multi-factorial account considers cognitive, experiential, physiological and behavioral parameters as relevant for constituting an emotion. However, each emotion type is constituted by a typical pattern according to which some features may be more significant than others. Emotions differ strongly where these patterns of features are concerned, while their essential functional roles are the same. We argue that emotions form a unified ontological category that is coherent and can be well defined by their characteristic functional roles. Our account of emotions is supported by data from developmental psychology, neurobiology, evolutionary biology and sociology. (shrink)

A standard view in philosophy is that knowledge entails justification. Yet recent research suggests otherwise. We argue that this admirable and striking research suffers from an important limitation: participants were asked about knowledge but not justification. Thus it is possible that people attributed knowledge partly because they thought the belief was justified. Perhaps though, if given the opportunity, people would deny justification while still attributing knowledge. It is also possible that earlier findings were due to perspective taking. This paper reports (...) further research that directly addresses these questions. Our findings support the hypothesis that knowledge entails justification on the ordinary view. (shrink)

Il me semble que le concept goodmanien d’exemplification permet de répondre au défi lancé par le sceptique. J’essaie de montrer pourquoi. Die Auffassung, daß Philosophie ein Produkt menschlicher Verstandestätigkeit sei und mit dem Denken der Griechen beginne, erweist sich dabei als Resultat eines Traditionsbruchs, mit dem die entstehende Aufklärung sich vom christlichen Aristotelismus der Schulphilosophie sowie von den platonisch-hermetischen Spekulationen der Schwärmer und Pansophen absetzte. In der Umbruchphase zwischen Barock und Aufklärung entsteht so (...) der moderne philosophiegeschichtliche Kanon, der sich fundamental von der zuvor gültigen historischen Logik der Wissenschaftsgeschichte unterscheidet. Die Geschichte der Philosophie wird nun nicht länger als Sammelbecken unterschiedlich perfekter Ausformulierungen einer archetypischen Weisheit verstanden, sondern im Kontext der 'Entdeckung der geschichtlichen Welt' als ein kontingenter temporaler Prozeß menschlicher Wissenschaftsentwicklung begriffen. Wie es zu dieser Entdeckung der Philosophiegeschichte kam und worin ihre wissenschaftsgeschichtlichen Implikationen bestehen, ist Gegenstand der Darstellung, die gegenüber der bisherigen Forschung verstärkt die Interdependenzen zwischen theologischem, philosophischem, rechts- und literärgeschichtlichem Diskurs berücksichtigt. Simple claims with the verb ‘seem’, as well as the specific sensory verbs, ‘look’, ‘sound’, etc., require the speaker to have some relevant kind of perceptual acquaintance (Pearson, 2013; Ninan, 2014). But different forms of these reports differ in their perceptual requirements. For example, the copy raising (CR) report, ‘Tom seems like he’s cooking’ requires the speaker to have seen Tom, while its expletive subject (ES) variant, ‘It seems like Tom is cooking’, does not (Rogers, 1972; Asudeh and Toivonen, 2012). This contrast has led some theorists to hold that the matrix subject in CR constructions is uniformly interpreted as the perceptual source (p-source) (Asudeh and Toivonen, 2012; Rett and Hyams, 2014). Others, based on examples of CR reports that seem not to require perception of the referent of the matrix subject, have taken the p-source interpretation instead to be non-uniform across CR reports (Landau, 2011; Doran, 2015). We reconsider these theoretical approaches to copy raising in light of new experimental work probing the sensitivity of these requirements to the matrix verb, the embedded ‘like’-clause, and the context. While we find some motivation for a non-uniform p-source analysis, it comes from importantly different cases than those others have relied on. Furthermore, our findings cast doubt on the prevalent assumption that the perceptual requirements of CR reports are to be captured solely by the presence or absence of the p-source interpretation. We suggest that the data motivating a non-uniform p-source view are better captured by an alternative approach, which makes use of a more minimal evidential source role, in place of the perceptual source role. We close by considering the relationship between English copy raising and evidential constructions cross-linguistically. (shrink)
